Terms of Use
These Terms of Use (“Terms”) are an agreement between you and DCApps (“we”, “us”, “our”) and govern your use of the FomoTrading mobile application (the “App”) and the website at fomotrading.pro (the “Website”). By downloading or using the App you accept these Terms. If you do not agree, do not use the App.
Our Privacy Policy explains how we handle your information and is part of these Terms.
1. A simulator with virtual money
- All balances, profits, losses, rewards and prizes in the App are virtual. They have no monetary value and cannot be purchased, deposited, withdrawn, transferred, sold, or exchanged for money, cryptocurrency or anything else of value.
- The App never places real orders. It is not a brokerage, exchange, wallet or investment service, and it does not hold or move any asset on your behalf.
- Simulated results do not predict real results. The simulation leaves out many real-world factors such as fees, slippage, liquidity and execution delays.
- The Fortune Wheel and the Slot Machine are games of chance played only for virtual currency. You cannot pay to play them, and their prizes have no real value.
2. Not financial advice
The App is for entertainment and education only. Nothing in the App or on the Website is investment, financial, legal or tax advice, or a recommendation to buy, sell or hold any asset. We are not a registered broker, dealer or investment adviser. Trading real cryptocurrency carries a high risk of loss; consult a qualified professional before making real financial decisions, and do not rely on your results in the App when you make them.
3. Market data
Prices in the App come from third-party sources, including Binance. They are provided “as is” and may be delayed, interrupted, incomplete or inaccurate. We do not guarantee their accuracy or availability.
4. Eligibility
You must be at least 18 years old, or the age of majority where you live if that is higher, to use the App. You are responsible for making sure that your use of the App is lawful where you live.
5. Accounts and progress
- The App creates an anonymous account the first time you open it. If you do not sign in with Google or Apple, your progress may be lost when you uninstall the App or change devices.
- You are responsible for the security of the Google or Apple account you sign in with.
- Virtual currency and in-game items are a limited license to use a feature of the App, not your property. We may adjust the game economy — including rewards, prizes, odds, costs and limits — or correct balances affected by errors or abuse, at any time and without compensation.
- You can delete your account at any time in Profile → Settings → Delete Account.
6. Ads and rewarded videos
The App contains advertising. Rewarded videos are optional and grant virtual currency; they depend on ad availability and may be subject to daily limits and waiting periods. We do not control and are not responsible for the content of third-party ads, and any dealings you have with an advertiser are between you and that advertiser.
7. Acceptable use
You agree not to:
- cheat, exploit bugs, or use bots, scripts or other automation to gain virtual currency or rewards;
- copy, modify, decompile or reverse engineer the App, except where the law expressly allows it;
- interfere with the App, its servers or its security, or access another player’s account;
- use a display name that is offensive, misleading or infringes someone else’s rights;
- use the App for any unlawful purpose.
8. Intellectual property
The App, the Website and their content, design and trademarks belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, in line with these Terms and the rules of the store you downloaded it from. Names and logos of cryptocurrencies belong to their respective owners and are used only to identify them; their use does not imply affiliation or endorsement.
9. Third-party services
The App relies on services from Google (Firebase, Sign in with Google), Apple (Sign in with Apple), AppLovin (advertising) and Binance (market data). Your use of those services is also subject to their own terms and policies, and we are not responsible for them.
10. Changes and availability
We may update, change, suspend or discontinue the App or any feature — including features announced as coming soon — at any time. We do not guarantee that the App will always be available or free of errors.
11. Termination
You may stop using the App and delete your account at any time. We may suspend or end your access if you break these Terms or if we discontinue the App. Sections 1–3, 8 and 12–14 continue to apply after termination.
12. Disclaimer of warranties
The App and the Website are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or virtual currency, arising from your use of the App. We are not liable for any loss resulting from real-world trading or investment decisions you make, whether or not they are based on the App. Our total liability for any claim relating to the App is limited to USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Governing law
These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
15. App Store and Google Play
If you downloaded the App from Apple’s App Store:
- these Terms are between you and us, not Apple, and we — not Apple — are responsible for the App;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation with respect to the App;
- Apple is not responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection claims, or claims that the App infringes a third party’s intellectual property rights;
- you confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the App from Google Play, the Google Play Terms of Service also apply to your download and use of the App.
16. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above and, for significant changes, let you know in the App or on the Website. By continuing to use the App after a change takes effect, you accept the updated Terms.
